1. Agreement to Terms

By accessing or using the Mobile Community Corrections Center ("Mobile CCC," "MCCC," "we," "us," or "our") website at www.mobileccc.gov, the MCCC Client Portal, or any services, programs, or resources provided by Mobile CCC, you ("you," "your," or "user") agree to be bound by these Terms and Conditions. If you do not agree with any part of these Terms and Conditions, you must not access or use our website or services. These Terms and Conditions constitute a legally binding agreement between you and Mobile CCC, a department of the Mobile County Commission.

2. Description of Services

Mobile CCC operates under the 13th Judicial Circuit and provides the courts with appropriate alternatives to incarceration. Our website and the MCCC Client Portal provide information about and access to our programs and services, including but not limited to the Community Corrections Program (CCP), Pretrial Services, Probation (Jail Diversion), Drug Court, Mental Health Court, Community Service, the AOD Laboratory, the Kiosk Program, the Inside Out Program, and related accountability court programs.

Through the MCCC Client Portal, eligible participants may view reporting schedules, check daily color codes, review upcoming appointments, and make payments online. Access to the Client Portal is limited to individuals who are actively enrolled in a Mobile CCC program and who have been provided login credentials.

3. Eligibility and Access

Use of our website is open to the general public for informational purposes. However, access to the MCCC Client Portal and certain program-specific features is restricted to authorized individuals, including program participants, legal representatives, and authorized Mobile CCC staff. You agree not to attempt to access restricted areas of the website or Client Portal without proper authorization. Any unauthorized access or use may result in legal action and referral to appropriate law enforcement authorities.

4. User Accounts and Security

If you are provided with a user account for the MCCC Client Portal, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify Mobile CCC immediately of any unauthorized use of your account or any other breach of security. Mobile CCC reserves the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to a violation of these Terms and Conditions or the requirements of your program.

5. Payments and Fees

Certain Mobile CCC programs require payment of administrative fees, supervision fees, drug testing fees, or other costs as ordered by the court. Payments may be made through the MCCC Client Portal or in person at our office. All fees are non-refundable unless otherwise required by law or court order. Mobile CCC reserves the right to modify fee schedules as necessary, and any changes will be communicated to affected participants. Failure to pay required fees may result in a report to the court and may affect your program status.

6. Program Participation and Compliance

Individuals enrolled in Mobile CCC programs are required to comply with all conditions imposed by the court and by Mobile CCC, including but not limited to attending scheduled appointments, submitting to drug testing, completing community service hours, participating in treatment programs, and reporting as directed. Failure to comply with program requirements may result in sanctions, program termination, or referral back to the court for further action. These Terms and Conditions do not supersede, replace, or modify any court orders, program agreements, or conditions of supervision.

7. Text Messaging and Mobile Communications

By opting in to receive text messages or SMS communications from Mobile CCC, you consent to receive program-related notifications, appointment reminders, reporting alerts, and other informational messages at the mobile number you have provided. Message and data rates may apply depending on your mobile carrier and plan. You may opt out of text messaging at any time by following the instructions included in our messages or by contacting our office directly.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Mobile CCC does not share any information with third parties or affiliates for the purpose of marketing or promotional activities. Mobile CCC is not responsible for delays or failures in message delivery caused by your mobile carrier, device, or network conditions.

8. Intellectual Property

All content on the Mobile CCC website, including but not limited to text, graphics, logos, images, the Mobile County Alabama seal, and software, is the property of Mobile CCC, the Mobile County Commission, or their respective licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content from our website without prior written consent from Mobile CCC, except as permitted for personal, non-commercial informational purposes.

9. Prohibited Conduct

When using our website or the MCCC Client Portal, you agree not to: use the website for any unlawful purpose or in violation of any applicable laws or regulations; attempt to gain unauthorized access to any portion of the website, other accounts, computer systems, or networks connected to the website; interfere with or disrupt the operation of the website or servers; transmit any viruses, malware, or other harmful code; impersonate any person or entity or misrepresent your affiliation with any person or entity; collect or harvest personal information of other users; or use the website in any manner that could damage, disable, overburden, or impair the website or interfere with any other party's use of the website.

10. Disclaimers

The Mobile CCC website and MCCC Client Portal are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. Mobile CCC does not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components. Mobile CCC makes no representations or warranties regarding the accuracy, completeness, or reliability of any information provided on the website. The information on this website does not constitute legal advice. For legal questions regarding your case or program participation, please consult with your attorney or contact the appropriate court.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Mobile CCC, the Mobile County Commission, their officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the website, the MCCC Client Portal, or any services provided by Mobile CCC. This limitation applies regardless of the theory of liability, including but not limited to breach of contract, tort, negligence, strict liability, or any other legal or equitable theory.

12. Indemnification

You agree to indemnify, defend, and hold harmless Mobile CCC, the Mobile County Commission, and their respective officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the website or MCCC Client Portal, your violation of these Terms and Conditions, or your violation of any rights of any third party.

13. Third-Party Links

Our website may contain links to third-party websites, including but not limited to the Mobile County Commission website, the Alabama Department of Corrections, and other government resources. These links are provided for your convenience and informational purposes only. Mobile CCC does not endorse, control, or assume responsibility for the content, privacy policies, or practices of any third-party websites. Your use of third-party websites is at your own risk, and we encourage you to review the terms and privacy policies of any external sites you visit.

14. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms and Conditions or your use of the Mobile CCC website or services shall be subject to the exclusive jurisdiction of the courts located in Mobile County, Alabama.

15. Modifications to Terms and Conditions

Mobile CCC reserves the right to modify, amend, or update these Terms and Conditions at any time and at our sole discretion. Any changes will be effective immediately upon posting the revised Terms and Conditions on our website with an updated effective date. Your continued use of the website or services after any such changes constitutes your acceptance of the revised Terms and Conditions. We encourage you to review these Terms and Conditions periodically.

16. Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable, consistent with the intent of the original provision.

17. Entire Agreement

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and Mobile CCC regarding your use of the website and MCCC Client Portal. These Terms and Conditions do not alter, amend, or supersede any court orders, program participation agreements, or conditions of supervision that may apply to you as a participant in any Mobile CCC program.
